About This Page

This page is a plain-language summary of FRW-008, the FRW Digital Product License, for your convenience. It is not itself controlling — where this summary and FRW-008 differ, FRW-008 governs. You can view the approved FRW Digital Product License here.

Who Holds the License

The license is held by the Licensee: the organization or individual that purchased the publication or receives it under a subscription, and, for an organization, its employees. For an individual Licensee, a site is a facility where the individual works; the individual doesn’t need to operate it.

What You’re Licensed To Do

On purchase, or on delivery under a subscription, FRW grants a perpetual, non-exclusive, non-transferable license to use the publication. How far it reaches depends on the product class:

  • Starter Pack, Category Pack, or Poster Pack — the license covers all of your sites. A Category Pack is a fixed set of toolbox talks, and a Poster Pack a fixed set of posters, assembled by FRW and sold as one product; the set does not change after sale.
  • Individual Resource (a single poster, toolbox talk, checklist, or form sold on its own) — the license covers only your Nominated Site: the site you identify at purchase, or, if none is identified, the site it was first supplied to. Using it at a further site requires a further purchase for that site, or a pack that contains it.
  • Toolbox talk subscription — each talk delivered under your subscription is licensed as an Individual Resource, with the site you identify at setup, after your first subscription payment, as its Nominated Site. The license is granted on delivery and is perpetual: talks already delivered stay licensed after the subscription ends, and a refund of a subscription charge does not end it.

What You May Do

Within your license, you may complete, adapt, and reproduce the publication for use at your own sites; distribute copies to your own employees and to contractors while they are performing work at your sites; retain completed copies as your own records, with no further obligation to FRW; print, post, and display the publication at your sites; and continue using copies you already have even after FRW revises the license or withdraws the publication. If you hold the license as an individual, you may also lead, post, and display a publication at your Nominated Site and give copies to the workers there, whoever employs them.

Consulting Use — Starter Packs Only

If you purchased a Starter Pack, you may use it as part of advisory, consulting, or implementation services you provide to your own clients, provided you adapt the publication for that engagement and do not supply it to the client, or anyone else, as a standalone FRW product. This does not extend to an Individual Resource, a Category Pack, a Poster Pack, or talks delivered under a subscription. An individual Licensee using a publication at its own Nominated Site is not providing a consulting service, even where that site belongs to a client; the client gets no license of its own from that use.

What’s Not Permitted

  • Reselling, sublicensing, leasing, or distributing a blank or unmodified publication, whether or not a charge is made.
  • Supplying the publication itself, in blank or unmodified form, to a client or any other third party as a deliverable.
  • Distributing it to any organization other than yours, except to contractors, for Starter Packs to clients, and for an individual Licensee to the workers at its Nominated Site, as described above.
  • Removing or obscuring the FRW document control block, document number, product code, or copyright notice from a blank or unmodified publication.
  • Using a publication, or any text or image in it, to train, fine-tune, or otherwise develop an artificial intelligence model or system, or supplying it to another party for that purpose.
  • Removing, altering, or obscuring any metadata, content credential, watermark, or other marking on an image in a publication, or any source file attached to it.
  • Using an Individual Resource at any site other than its Nominated Site, or using an Individual Resource, Category Pack, or Poster Pack in services provided to a client.
  • Stating or implying that FRW has reviewed, approved, certified, or accepted responsibility for a completed copy or an adaptation.
  • Using FRW names, logos, or brand assets outside the publication as supplied, including in a way that suggests a client’s deliverable is itself an FRW product.

Ownership

FRW retains ownership of the publication and all intellectual property in it. You own the content you enter into a completed copy, and the completed copy itself as your own record, but not the underlying publication.

Revision Entitlement

For a publication you purchase, you are entitled for six months from your purchase date to the current released revision whenever FRW issues one, at no charge. The entitlement ends if the license ends, including on refund. A toolbox talk delivered under a subscription carries no revision entitlement: it is generated for you and is not revised or reissued after delivery. If a publication you hold is withdrawn or corrected for a safety reason, FRW notifies you whether or not any entitlement is current.

Termination and Refunds

The license continues indefinitely unless it ends. FRW may end the license of a Licensee who breaches the prohibited uses above. The license to a purchased publication ends automatically if that purchase is refunded. A refund of a subscription charge does not end the license to talks already delivered. When a license ends, you stop using and distributing the publication and delete the copies supplied, but you may keep completed copies already made as records of work already performed; keeping them does not permit using the publication for new work.

No Certification of Compliance

FRW publications are implementation resources. They do not certify compliance, do not replace a site-specific hazard assessment, and do not supersede federal, state-plan, local, collective-bargaining, equipment-manufacturer, or site requirements. Regulatory and standards text is cited, not reproduced, and citation implies no endorsement by any regulator or standards body. Publications are supplied as is.

Which Revision Applies

A revision of FRW-008 does not change the terms under which a publication already supplied was licensed.
